A man is behind bars after police say he shot a gun off before hitting his neighbor on the head with it.

Kennewick officers say a 25-year-old went to a lower apartment Monday morning to tell his 35-year-old neighbor to turn down his music because it was waking up other neighbors.

Officers say the 35-year-old was reported to get confrontational and started to assault his neighbor. During the incident, the 25-year-old’s handgun he was carrying fell from his pocket.

The 35-year-old man picked it up and pointed it at his neighbor, the fight continued and the gun went off. The shot didn’t hit anyone. Officers say the 35-year-old then hit his neighbor on the head with the gun before dropping it and running back inside.

When police arrived the 35-year-old would not come out. Officers broke in with a search warrant and arrested the man. He faces assault 2nd and felon in possession/discharging a firearm.

They say the 25-year-old had minor injuries after being hit on the head. He was legally carrying the gun.
